Welkom op onze website. Door gebruik te maken van deze website, gaat u akkoord met de vermelde algemene voorwaarden. Deze gebruiksvoorwaarden kunnen door ons gewijzigd worden. De gewijzigde gebruiksvoorwaarden zijn van kracht op het moment dat ze op de website geplaatst worden.

Intellectuele eigendom

De website en alle eigendommen behorende tot of geassocieerd met HumanInsight, met inbegrip van alle merk- en/of handelsnamen, logo’s en software, en alle informatie en andere inhoud op deze website zijn en blijven ten allen tijde onze eigendom en zijn beschermd door wereldwijde auteursrechten en internationale contractsbepalingen. U gaat hierbij akkoord dat u onder geen enkele omstandigheid inbreuk maakt op deze rechten.

Gegevensbescherming

Alle persoonlijke informatie die u aan ons verstrekt wanneer u deze website gebruikt, zal worden verwerkt in overeenstemming met ons Privacybeleid.

Algemene voorwaarden HumanInsight

Rechtsverhouding

De rechtsverhouding tussen HumanInsight CommV, met maatschappelijke zetel Kleine Goddaard 12 bus 3?3, 2000 Antwerpen, KBO-nummer BE 0740.959.244 (hierna HumanInsight genoemd) en de klant, valt onder de ‘Algemene Voorwaarden HumanInsight’.
De Algemene Voorwaarden HumanInsight hebben voorrang op de algemene en/of andere voorwaarden van de klant, zelfs indien deze bepalen dat zij als enige gelden.
Afwijkingen ten opzichte van de Algemene Voorwaarden HumanInsight zijn slechts mogelijk na voorafgaande en schriftelijke toestemming van HumanInsight.

Prestaties

De prestaties van HumanInsight bestaan uit (1) het organiseren van opleidingen, trainingen, workshops, inspiratiesessies, intervisies, supervisies, coaching, opleidingsformules, leertrajecten, e-learning, online opleidingen, (2) het verlenen van advies en adviestrajecten, en (3) de logistieke en organisatorische ondersteuning hiervan voor de klant. Hierna worden deze prestaties gezamenlijk aangeduid als 'Opleidingen'.

‘Incompany Opleidingen’ zijn opleidingen waaraan enkel werknemers of relaties van de klant kunnen deelnemen.
‘Open Opleidingen’ zijn opleidingen waaraan de klant, al dan niet gelijktijdig samen met andere klanten, kan deelnemen.

Betaal- en annulatievoorwaarden

Offertes

Alle offertes van HumanInsight gelden voor een periode van zes weken, tenzij in de offerte een andere termijn wordt genoemd.
De opdracht wordt beschouwd als bevestigd na goedkeuring van de offerte door de opdrachtgever. Dit kan via e-mail of door ondertekening van de offerte in kwestie.
De in een offerte vermelde prijzen zijn exclusief BTW. Ze zijn ook exclusief eventuele in het kader van de opdracht te maken kosten, zoals accommodatie, reis- en verblijf-, verzend- en administratiekosten, tenzij anders aangegeven.

Betaalvoorwaarden

De betalingstermijn is 30 kalenderdagen na factuurdatum.
Bij niet-betaling van de factuur op de vervaldag, rekenen we de wettelijk bepaalde nalatigheidsinteresten aan: 8,5% op jaarbasis.
Klachten moeten ons binnen de 8 dagen na factuurdatum bereiken.
Enkel rechtbanken van het arrondissement Antwerpen zijn gemachtigd om geschillen te beslechten.

Annulering door de klant

Voor Incompany Trainingen geldt de volgende regeling:

- De klant kan kosteloos annuleren tot 5 weken voor het begin van de Incompany Training.
- Bij annulering tussen de 5 en 2 weken voor het begin van de Incompany Training betaalt de klant 50% van het bedrag vermeld in de offerte.
- Bij annulering minder dan 2 weken voor het begin van de Incompany Training blijft het volledige bedrag vermeld in de offerte verschuldigd.
- De klant betaalt, bij annulering minder dan 5 weken voor het begin van de Incompany Training, ook alle kosten die door HUMANINSIGHT reeds gemaakt werden bij de voorbereiding van de Incompany Training (bv. voorbereidingstijd van de trainer, reservatiekosten van leslokalen, ).

De klant kan de geplande trainingsdagen van een incompany opleiding kosteloos verschuiven tot 5 weken voor het begin van de geplande trainingsdagen.

- Bij verschuiving van de geplande opleidingsdagen tussen de 5 en 2 weken voor het begin van de geplande trainingsdagen betaalt de klant bovenop de overeengekomen lesdagvergoeding een bijkomende kostenvergoeding gelijk aan 25% van de lesdagvergoeding.
- Bij verschuiving van de geplande opleidingsdagen minder dan 2 weken voor de geplande trainingsdagen: klant betaalt bovenop de overeengekomen lesdagvergoeding een bijkomende kostenvergoeding van 50% van de lesdagvergoeding.
- Bij verschuiving van de geplande trainingsdagen van een Incompany Training minder dan 5 weken voor het begin van de geplande trainingsdagen betaalt de klant ook alle kosten die door HUMANINSIGHT reeds gemaakt werden voor reservatie van leslokalen m.b.t. deze Incompany Training.
- De nieuwe datum van de incompany opleiding die wordt afgesproken tussen HumanInsight en de klant moet vallen binnen de 6 maanden na de oorspronkelijk afgesproken datum.
- Er wordt 1 keer een verschuiving van de geplande trainingsdagen van een incompany opleiding toegestaan. In het geval van een 2e verschuiving, gelden de voorwaarden in verband met de annulering van een incompany opleiding, zoals hierboven omschreven.

Legal relationship

The legal relationship between HumanInsight CommV, with registered office Kleine Goddaard 12 box 3.3, 2000 Antwerp, KBO number BE 0740.959.244 (hereinafter referred to as HumanInsight) and the client, is governed by the 'General Terms and Conditions HumanInsight'.
The General Terms and Conditions HumanInsight shall prevail over the general and/or other terms and conditions of the client, even if these stipulate that they are the only ones to apply.
Deviations from the HumanInsight General Conditions are only possible after prior and written consent of HumanInsight. HumanInsight refers the right to change its General Terms & Conditions.

Services

The services rendered by HumanInsight consist of (1) the organisation of education, training, workshops, inspiration sessions, intervisions, supervisions, coaching, training formulas, learning trajectories, e-learning, online training, (2) the provision of advice and consultancy trajectories, and (3) the logistical and organisational support thereof for the client. Hereafter, these services are collectively referred to as 'Training Courses'.

'Incompany Training Courses' are training courses in which only employees or relations of the client can participate.
'Open Programmes' are Programmes in which the client can participate, simultaneously with other clients or not.

Payment and cancellation conditions.

Offers

All offers made by HumanInsight remain valid for a period of six weeks, unless a different period is mentioned in the offer.
The assignment is considered confirmed after approval of the offer via e-mail by the client.
The prices stated in an offer are exclusive of VAT. They are also exclusive of any costs to be incurred in connection with the assignment, such as accommodation, travel and accommodation, shipping and administration costs, unless otherwise indicated.

Payment conditions

The payment terms are 30 calendar days from the invoice date.
In case of non-payment of the invoice on the due date, we will charge statutory late payment interest: 8,5% on an annual basis.
Complaints must reach us within 8 days of the invoice date.
Only courts of the Antwerp district are authorised to settle disputes.

Cancellation by the client

The following arrangement applies for In-company Training Courses.

The customer can cancel free of charge up to five weeks before the start of the In-company Training Course.
In the event of cancellation between five and two weeks before the start of the In-company Training Course, the customer pays 50% of the amount stipulated in the contract.
In the event of cancellation less than two weeks before the start of the In-company Training Course, full amount stipulated in the contract remains due.
In the event of cancellation less than five weeks before the start of the In-company Training Course, the customer also pays all costs already incurred by HUMANINSIGHT when preparing the In-company Training Course (e.g. trainer preparation time, classroom booking costs).

The customer can reschedule the planned training days of an In-company Training Course free of charge up to five weeks before the start of the scheduled training days.

If the scheduled training days of an In-company Training Course are rescheduled between five and two weeks before the start of the scheduled training days, the customer pays additional compensation equal to 25% of the course day fee in addition to the agreed course day fee.
If the customer reschedules the scheduled training days of an In-company Training Course less than two weeks before the start of the scheduled training days, the customer pays additional compensation equal to 50% of the course day fee in addition to the agreed course day fee.
If the scheduled training days of an In-company Training Course are rescheduled less than five weeks before the start of the scheduled training days, the customer also pays all the costs already incurred by HUMANINSIGHT to book classrooms for this In-company Training Course.
In addition, the new date of the In-company Training Course agreed between HUMANINSIGHT and the customer must fall within six months of the originally agreed date.
The scheduled training days of an In-company Training Course may be rescheduled once. In the event of a second rescheduling, the conditions relating to the cancellation of an In-company Training course, as set out above, apply.

Relations contractuelles

Les relations contractuelles entre HumanInsight CommV, dont le siège social est établi Kleine Goddaard 12 box 3.3, 2000 Anvers, enregistrée à la BCE sous le numéro BE 0740.959.244 (ci-après dénommée « HumanInsight »), et le client sont régies par les présentes conditions générales.
Le Conditions Générales prime les conditions générales et/ou autres du client, même si ces dernières prévoient qu’elles s’appliquent de façon exclusive.
Toute dérogation au Conditions Générales n’est possible que moyennant l’accord préalable et écrit de HUMANINSIGHT. HUMANINSIGHT se réserve le droit de modifier les dispositions du Conditions Générales.

Prestations

Les prestations de HUMANINSIGHT ont pour objet l’organisation de formations, trainings, coaching, formules de formation, programmes d’accompagnement, trajets de développement, e-learning, formations en ligne et toutes autres formes de formation ainsi que le soutien logistique et organisationnel de formations pour le client. Les prestations seront collectivement dénommées ci-après « (les) Formations ».

Les « Formations Intra-Entreprise » sont des formations auxquelles seuls les travailleurs ou relations du client peuvent participer.
Les « Formations Ouvertes » sont des formations auxquelles le client peut participer, en même temps ou non que d’autres clients. Sont notamment visés ici, sans que cette énumération soit limitative : les ventes one-off de formations, les packages de formation.

Formation Intra-Entreprise

Offres

Toutes les offres faites par HumanInsight sont valables pour une période de six semaines, sauf si une période différente est mentionnée dans l'offre.
La mission est considérée comme confirmée après l'approbation de l'offre par e-mail par le client.
Les prix mentionnés dans une offre s'entendent hors TVA. Ils ne comprennent pas non plus les frais liés à la mission, tels que les frais d'hébergement, de voyage et de séjour, les frais d'expédition et les frais administratifs, sauf indication contraire.

Modalités de paiement

Les délais de paiement sont de 30 jours calendaires à compter de la date de facturation.
En cas de non-paiement de la facture à la date d'échéance, nous facturerons des intérêts de retard légaux : 8,5% sur une base annuelle.
Les plaintes doivent nous parvenir dans les 8 jours suivant la date de facturation.
Seuls les tribunaux de l'arrondissement d'Anvers sont habilités à régler les litiges.

Annulation par le client

Pour les Formations Intra-Entreprise, les règles sont les suivantes.

Le client peut annuler sans frais jusqu’à 5 semaines avant le début de la Formation Intra-Entreprise.
En cas d’annulation entre 5 et 2 semaines avant le début de la Formation Intra-Entreprise, le client paie 50% du montant mentionné dans le Contrat.
En cas d’annulation moins de 2 semaines avant le début de la Formation Intra-Entreprise, l’intégralité du montant mentionné dans le Contrat reste due.
En cas d’annulation moins de 5 semaines avant le début de la Formation Intra-Entreprise, le client paie également tous les frais déjà encourus par HUMANINSIGHT dans le cadre de la préparation de la Formation Intra-Entreprise (p.ex. le temps de préparation du formateur, les frais de réservation des salles de cours...).

Le client peut reporter sans frais les journées de formation prévues d’une Formation Intra-Entreprise jusqu’à 5 semaines avant le début des journées de formation prévues. .

En cas de report des journées de formation prévues d’une Formation Intra-Entreprise entre 5 et 2 semaines avant les journées de formation prévues, le client paie, en plus de la rémunération convenue de la journée de cours, une indemnité supplémentaire égale à 25 % de la rémunération de la journée de cours.
Si le client reporte les journées de formation prévues d’une Formation Intra-Entreprise moins de deux semaines avant le début des journées de formation prévues, le client paie, en plus de la rémunération convenue de la journée de cours, une indemnité supplémentaire égale à 50 % de la rémunération de la journée de cours.
En cas de report des journées de formation prévues d’une Formation Intra-Entreprise moins de 5 semaines avant le début des journées de formation prévues, le client paie également tous les frais déjà encourus par HUMANINSIGHT pour la réservation des salles de cours concernant cette Formation Intra-Entreprise.
Par ailleurs, la nouvelle date de la Formation Intra-Entreprise convenue entre HUMANINSIGHT et le client doit tomber dans les 6 mois qui suivent la date initialement convenue.
Un seul report des journées de formation prévues d’une Formation Intra-Entreprise est autorisé. Dans le cas d’un 2e report, les conditions en vigueur en cas d’annulation d’une Formation Intra-Entreprise, L’inscription à un Enregistrement de Formation en ligne ne peut être annulée. Cette inscription est personnelle et nominative et ne peut être transférée à une autre personne. Dans ce cas, le client qui ne peut participer à la formation ne peut pas non plus se faire remplacer par une autre personne. Telles que définies ci-dessus, sont d’application.
